ITMS247:
ITMS247® Limited

Software:
Any software, associated third party software, open-source libraries and site-based code used in the provision of the ITMS247 service.

Legitimate User:
A legitimate user (hereinafter referred to as a “User”) is a person, corporate entity or an employee of a corporate entity who is approved by ITMS247. This approval is given subject to the conditions of any superior or related contract with the User or third party who is a mutual customer. Every legitimate user would have express permission from his/her direct ITMS247 Administrator to use ITMS247.

Risk and Limitations of Use

The User expressly acknowledges and agrees that to the maximum extent permitted by applicable law, use of the Software is at the User’s sole risk.

User's Responsibilities

• The User is responsible to close or disable inactive accounts.
• The User is responsible to manage his/her/their access credentials in a secure and confidential manner.
• The User is responsible for the information or data entered into ITMS247 to make sure it is accurate, non-offensive and non-infringement on copyright claims.
• The User is responsible for using ITMS247 in the way it is designed and intended to be used. The User is responsible to ask for training is s/he does not know how the ITMS247 is intended to be used.
• The User is responsible for his/her/their actions, behaviour and conduct whilst using ITMS247.

Limitations of Liability

To the maximum extent permitted by applicable law, ITMS247 hereby disclaims all warranties and conditions with respect to the Software and any services performed by use of the Software, either express, implied or statutory, including, but not limited to, the implied warranties and/or conditions of fitness for a particular purpose, accuracy, non–infringement of third party rights or other implied warranties or conditions. No oral or written information or advice given by ITMS247 or by a representative shall create a warranty of any kind. In no event will ITMS247 be liable (whether under contract, tort (including negligence) or otherwise) for: incidental, consequential, special, indirect or other damages or claims resulting from the breach of any express or implied warranty. Such damages may include but are not limited to the following:

• Any loss of profit or any other commercial damage
• Partial or total loss of data incurred whilst using the Software
• The cost of recovery of lost data
• Inability to use or to continue to use the Software itself or any connected device
• Damage to property
• Damage based on inconvenience, loss of time or interrupted operation and, to the extent permitted by law, damages for personal injury
